Cell Phone Guidelines
Time of transition
The use of cell (cellular, mobile) phones has become an ingrained part of our lives both at work and in our personal lives. As we have become accustomed to instant communication, entertainment, social connection, and information, we can be distracted from the important work we do at Racker. We need cell phones for work, and they can’t interfere with our work. Due to this dynamic we have implemented “phone zones” at Racker. The zones are Red-Never OK; Yellow-Sometimes OK; Green-Always OK. Please refer to your program to know your zones. Staff will be aware of the “phone zones” for their program prior to using a personal cellular phone. To support people to lead fulfilling lives, provide opportunities to learn and be connected with others, we need to be present with the individuals we support. We can’t stay focused on what matters when we’re focused on our phones.
Personal Phone Use
It is understood there will be times when it is necessary to place or receive personal calls while at work. Whether using the site phone, a personal cellular phone or another type of mobile device, it is the expectation that personal calls, texting, social media, or otherwise using mobile devices while working will be kept to a minimum in frequency and duration for anything non-work related. Please make every attempt to wait until a break.
Confidentiality
Personal phone use that breaches confidentiality is serious and at no time should an employee use their personal phone in a way that could violate the Health Insurance Portability and Accountability Act (HIPPA), the Family Educational Rights and Privacy Act (FERPA), or for other uses of Protected Health Information (PHI). Photos, documents, and other PHI should not be downloaded to a personal phone. It is never permissible to use a personal cellular phone or other mobile device to text or video chat about any personal information about a person or people you are supporting unless directed to do so by a program supervisor or director. Further, the use of a personal cell phone or mobile device to create (including generating images/ photos), store, communicate, or transmit personal information about anyone receiving supports and services is considered a breach of confidentiality and security of information. This also applies to staff transmitting or otherwise displaying personal information of people supported, on any form of social media outside of Racker’s Viva Engage (Yammer) page provided the use does not violate the program policy or guidelines and photo and/or video permission has been obtained.
Putting People At Risk
It is dangerous and unlawful in New York State to hold and view or use a handheld cell phone while operating a vehicle. Termination of employment may result should an employee be found using a handheld cellular phone while operating an agency vehicle or when transporting someone you support, in your personal vehicle. All traffic fines associated with the violation will be the responsibility of the employee. Additionally, the program may be required to file a report with an external agency based on the program requirements. Please note: the ‘offense’ may result in criminal charges.
